Please read these Terms of Service carefully before using Air Commerce. By accessing or using our Services, you agree to be bound by these Terms.
These Terms of Service ("Terms") constitute a binding agreement between Air Commerce ("we", "us", "our") and the customer ("you") who accesses or uses our website, platform, software, and related services (collectively, the "Services").
By registering, logging in, or otherwise using any part of the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, please discontinue use immediately.

The following definitions apply throughout these Terms:
Air Commerce provides software tools for retail merchants and Live Commerce sellers, including automated order collection, payment verification, stock management, and shipping coordination, subject to the subscription plan chosen.
The Services may evolve over time through updates, new features, or improvements. We reserve the right to modify, suspend, or limit access to parts of the Services temporarily for maintenance, security improvements, or legal compliance. We will endeavour to notify you in advance when reasonably practicable.
Feature availability, transaction limits, and platform capabilities per subscription plan are as described on our pricing page at the time of enrolment.
Customers are responsible for maintaining the confidentiality of their account credentials, passwords, and authentication details, and for controlling access by authorised Users within their organisation.
You must not share account credentials with third parties or permit unauthorised use of your account without our prior written consent.
If you suspect unauthorised access to your account, notify us immediately at info@air-commerce.com. All activity conducted through your account is your responsibility until you have notified us and we have confirmed the account suspension.

Customers retain all intellectual property rights and ownership of their Customer Content. Using our Services does not transfer any ownership rights to Air Commerce.
Customers grant Air Commerce a limited licence to host, process, and display Customer Content solely to the extent necessary to operate the subscribed Services.
Customers warrant that their content does not infringe third-party rights, does not contain unlawful material, and is free from malware. Customers bear full responsibility for their own content.
Upon termination, Customers may export their data within 30 days after the termination date. After this period, data will be deleted in accordance with our data retention procedures, except where we are required by law to retain certain records.
Fees are based on the pricing plan published on our website, or on a written order form or quote agreed between the parties. Prices are inclusive of VAT unless stated otherwise.
Customers must pay fees by the due date specified. Payments more than 7 days overdue may result in temporary suspension of the Services until the outstanding balance is settled.
Where a free trial or promotional offer is available, its terms are as communicated at the time. Standard fees apply automatically after the trial period unless the Customer cancels before it ends.
Fees paid are non-refundable upon mid-term cancellation by the Customer, except where Air Commerce terminates the agreement through no fault of the Customer.
All software, code, algorithms, designs, trademarks, domain names, and documentation related to the Air Commerce platform are the property of Air Commerce or its licensors, protected by Thai intellectual property law and applicable international treaties.
We grant Customers a limited, non-exclusive, non-transferable licence to use the Services within the scope of their chosen plan. This does not include any right to copy, adapt, translate, decompile, reverse engineer, sell, or distribute any part of the Services without our express written permission.
Air Commerce makes reasonable efforts to maintain system stability and availability. However, the Services are provided "as is" without warranty that they will be error-free or available without interruption at all times.
To the extent permitted by Thai law, Air Commerce is not liable for indirect, special, or consequential damages, including loss of revenue, data, or business opportunity, regardless of the cause.
Air Commerce's total aggregate liability to a Customer in connection with any claim shall not exceed the fees paid by that Customer in the 3 months preceding the event giving rise to the claim.
Customers may cancel the Services at any time by providing at least 30 days written notice. Cancellation takes effect at the end of the current billing cycle.
Air Commerce may suspend or terminate the Services if: the Customer materially breaches these Terms, engages in unlawful activity, fails to pay fees for more than 30 days, or engages in conduct harmful to the platform or other users. We will endeavour to notify you in advance where possible.
Upon termination, Customers retain the ability to export their data for 30 days, after which data will be deleted in accordance with our retention procedures.
We may update these Terms as needed. For material changes, we will publish the update on our website and notify Customers by email at least 30 days before the change takes effect.
Continued use of the Services after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, please notify us and discontinue use before the effective date.
These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand.
In the event of a dispute, the parties will first attempt to resolve it through good-faith negotiation. If no resolution is reached within 60 days, disputes shall be submitted to the courts of competent jurisdiction in Thailand.
